Request for Evaluation

A school district will, within 30 days of receipt of a request for an evaluation, either obtain parental request for an initial evaluation or provide to the parents prior written notice stating that the school district does not suspect a disabitiy and will not be conducting an evaluation. Rule 3301-51-06 [(B)(3)]

Development of Initial IEP

The initial IEP must be developed within whichever of the following time periords is shortest:

  1. Within 30 calendar days of the determination that the child needs special educaiton and related services;
  2. Within 90 calendar days of receiving parental request for an initial evaluation; or
  3. Within 120 calendar days of the receipt for request for an evaluation from a parent of school district.

Written Evaluation Team Report

The school district must provide a copy of the evaluation team report and the documentation of determination of eligiblity or continued eligibility to the parents prior to the next IEP meeting and in no case later than 14 days from the date of eligibility determination. Rule 3301-51-06 [(G)(1)(b)]

Parent Copy of Child’s IEP

Within 30 calendar days after the IEP meeting, the school district must give the parent a copy of the child’s IEP at no cost to the parent. Rule 3301-51-07 [(J)(6)]

Amendment of IEP

If the IEP amends or modifies the child’s current IEP, the annual review date for the amended or modified IEP does not change. The annual review date will change upon a complete review and revision fo the child’s IEP. When an IEP is amended, the school district shall send a copy of the amended IEP to the parent within 30 days of the date the IEP was amended. Rule 3301-51-07 [(L)(1)(f)]
